Financial Framework (Supplementary Powers) Regulations 1997
This is the Financial Framework (Supplementary Powers) Amendment (Health Measures No. 4) Regulation 2016.
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

176 | Rural General Practice Grants Program | To provide funding to existing general practices in rural and regional Australia to build or purchase additional infrastructure or equipment to support the delivery of health services and to support the practices in providing clinical placements to students training to become health practitioners. This objective also has the effect it would have if it were limited to measures: (a) providing, or incidental to the provision of, sickness benefits, hospital benefits or medical services; or (b) giving effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12. |
177 | Perinatal depression online support tool | To support pregnant women and new mothers experiencing, or at risk of developing, perinatal depression by: (a) developing resources and support tools relating to perinatal depression for delivery online; and (b) developing mobile applications for the delivery of resources and support tools relating to perinatal depression online; and (c) the delivery of resources and support tools relating to perinatal depression online via a website and mobile application. This objective also has the effect it would have if it were limited to measures: (a) in connection with online communications; or (b) giving effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12. |
178 | Protecting Australians from Antimicrobial Resistance | To improve Australia’s capacity to detect, prevent and respond to antimicrobial resistance in support of the National Antimicrobial Resistance Strategy 2015‑19 by: (a) continuing and enhancing existing surveillance activities relating to antimicrobial resistance; and (b) collecting and reporting data relating to antimicrobial resistance in Australia, including reporting data to the World Health Organization; and (c) identifying risks and trends relating to antimicrobial resistance; and (d) developing a plan and resources for general practitioners to support improved antimicrobial stewardship in general practice; and (e) developing and maintaining a website (including developing content for the website) to improve public knowledge about antimicrobial resistance, including about its causes and effects. This objective also has the effect it would have if it were limited to measures: (a) in connection with electronic communications; or (b) involving the collection, compilation, analysis or dissemination of statistics; or (c) providing, or incidental to the provision of, medical services, sickness benefits, hospital benefits or pharmaceutical benefits; or (d) giving effect to Australia’s obligations under the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; (ii) the International Health Regulations, particularly Articles 5‑10 and 44; or (e) taken in the exercise of the executive power of the Commonwealth. |
179 | Drug and Alcohol Program | To reduce the impact of substance misuse on individuals, families, carers and communities, by: (a) the provision of drug and alcohol treatment services, including through prevention, diagnosis and early intervention activities; and (b) treating health conditions arising from drug or alcohol misuse (including conditions in children arising from alcohol or drug use during pregnancy); and (c) supporting individuals, families, carers and communities affected by drug or alcohol misuse or the effects of such misuse; and (d) the development of data to support evidence‑based treatment, national policy development and service delivery; and (e) supporting drug and alcohol treatment services, including to better integrate those services with broader health services; and (f) training and educating health professionals and other health service providers, including by fostering the development of clinical and technical networks and supporting professional development and information sharing; and (g) supporting organisations representing the interests of, and providing services to, individuals, communities and families affected by drug or alcohol misuse or the effects of such misuse; and (h) raising awareness of, providing education and advice on, and developing and disseminating information about drug and alcohol misuse (including prevention, treatment, management, control and the health effects of misuse); and (i) supporting research relating to drug and alcohol misuse. This objective also has the effect it would have if it were limited to: (a) in connection with electronic communications; or (b) providing, or incidental to the provision of, sickness benefits, pharmaceutical benefits, hospital benefits or medical services; or (c) providing assistance to Aboriginal persons or Torres Strait Islanders; or (d) giving effect to Australia’s obligations under the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; (ii) the Single Convention on Narcotic Drugs (as amended), particularly Article 38; (iii) the Convention on Psychotropic Substances, particularly Article 20; (iv) the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, particularly Article 14; (v) the Convention on the Rights of Persons with Disabilities, particularly Articles 4, 8, 25 and 26; (vi) the Convention on the Rights of the Child, particularly Articles 4, 23 and 24; or (e) measures undertaken in the exercise of the executive power of the Commonwealth; or (f) involving the granting of financial assistance to a State or Territory. |
180 | Primary Health Care Development Program | To strengthen health care outcomes through facilitating access to, and improving the quality, efficiency and availability of, health and medical services in the community by: (a) providing and commissioning health care services, including developing and implementing new or revised models of care delivery or payment approaches; and (b) providing health care advice, information and support through a range of communication channels; and (c) facilitating the coordination and integration of health care services offered for selected patient cohorts in the community and across other sectors such as acute care, ambulatory care, specialist care and residential aged care services; and (d) supporting the development and implementation of accreditation processes and standards for health professionals and other health service providers; and (e) establishing and facilitating data collection, data sharing and associated quality improvement processes in general practices and Aboriginal medical services; and (f) providing support to general practice, health professionals and other health service providers: (i) to improve patient health outcomes; and (ii) to enhance the practice and organisation of care; and (g) training and educating health professionals, general practice staff and other health service providers; and (h) providing support to general practice, health professionals and other health service providers in enhancing the practice and organisation of care; and (i) informing the public about health services and programs; and (j) undertaking evaluation activities to inform decisions relating to existing or potential new Commonwealth health programs and measures. 181 | Health Policy Research and Data Program | To build a strong evidence base to inform the development, implementation, monitoring and evaluation of health policy and improved practice in Australia, including by funding universities and other organisations and persons to conduct: (a) research on a range of subject matters relevant to health policy (including activities supporting the dissemination of research and knowledge exchange); and (b) evaluation activities to inform decisions relating to existing or potential new Commonwealth health programs or measures; and (c) data activities, including the following: (i) developing and operating data infrastructure; (ii) developing data definitions; (iii) the collection, development and management of data; (iv) data analysis and interpretation; (v) data dissemination, reporting and use. This objective also has the effect it would have if it were limited to measures: (a) in connection with electronic communications; or (b) involving the collection, compilation, analysis or dissemination of statistics; or (c) relating to the health of, or provision of health services to, immigrants or aliens; or (d) incidental to the provision of medical services, sickness benefits, hospital benefits or pharmaceutical benefits; or (e) relating to the health of, or provision of, health services to Aboriginal persons and Torres Strait Islanders; or (f) giving effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; or (g) taken in the exercise of the executive power of the Commonwealth; or (h) peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or (i) involving the granting of financial assistance to a State or Territory; or (j) carried out in a Territory. |
182 | Health Protection Program | To support activities that strengthen the nation’s capacity and capability to detect, prepare for and respond to health emergencies and communicable diseases, including by: (a) maintaining laboratory capacity and capability for, and providing laboratory services in the event of, a health emergency; and (b) maintaining a register of biological agents of security concern; and (c) developing and implementing measures to support health emergency response activities; and (d) providing emergency response training and support to health personnel; and (e) developing, and implementing as necessary, a communications campaign for responding to health emergencies; and (f) maintaining a stockpile of pharmaceuticals, vaccines and other health resources for distribution in health emergencies; and (g) commissioning research relating to potential or emerging public health threats; and (h) developing and implementing quarantine and biosecurity measures; and (i) developing and implementing communicable disease related surveillance, controls, data collection, research, analysis and reporting, including in countries from which diseases could spread to Australia; and (j) supporting activities aimed at reducing the incidence of communicable diseases, including blood‑borne viruses and sexually transmissible infections; and (k) informing the public, affected persons and health practitioners about communicable diseases and their prevention and treatment; and (l) commissioning research about health issues arising from environmental factors. This objective also has the effect it would have if it were limited to measures: (a) in connection with electronic communications; or (b) relating to the defence of the Commonwealth; or (c) relating to quarantine; or (d) involving the collection, compilation, analysis or dissemination of statistics; or (e) relating to the health of, or provision of health services to, immigrants or aliens; or (f) providing, or incidental to the provision of, pharmaceutical benefits, sickness benefits, hospital benefits or medical services; or (g) providing assistance to Aboriginal persons or Torres Strait Islanders; or (h) giving effect to Australia’s obligations, including those under the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; (ii) the International Health Regulations, particularly Articles 5‑10 and 44; or (i) relating to matters affecting Australia’s relations with foreign countries and international organisations; or (j) taken in the exercise of the executive power of the Commonwealth; or (k) peculiarly adapted to the government of a nation and that cannot otherwise be carried on for the benefit of the nation; or (l) involving the granting of financial assistance to a State or Territory. |
183 | Public Health and Chronic Disease Program | To address the rising burden of chronic disease and improve public health by: (a) improving the quality of existing health services; and (b) supporting the development of new health services, controls and practices; and (c) raising awareness of, providing education and advice on, and developing and disseminating information about health conditions (including their prevention, treatment, management and control), health services and family planning; and (d) training and educating health professionals and other health service providers; and (e) informing the public about health policy, programs, research and best practice; and (f) providing support services to persons with health conditions and their families; and (g) conducting health checks for particular groups; and (h) implementing, developing and promoting food and nutrition policy, including a health star rating system for food labelling; and (i) enhancing the quality of, improving access to, and supporting, palliative care, end of life care and advance care planning services. This objective also has the effect it would have if it were limited to measures: (a) in connection with electronic communications; or (b) involving the collection, compilation, analysis or dissemination of statistics; or (c) providing, or incidental to the provision of, benefits to students, sickness benefits, pharmaceutical benefits, hospital benefits or medical services; or (d) providing assistance to Aboriginal persons or Torres Strait Islanders; or (e) giving effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; or (f) taken in the exercise of the executive power of the Commonwealth. |
