1  Name

  This instrument is the Industry Research and Development (Cyber Security Small Business Program) Instrument 2017.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under section 33 of the Industry Research and Development Act 1986.

4  Definitions

Note: Entity is defined in the Act.

  In this instrument:

Act means the Industry Research and Development Act 1986.

CREST ANZ means CREST Australia New Zealand Ltd.

Note: CREST is short for the Council of Registered Ethical Security Testers.

small business means an entity that:

 (a) has an ABN, and is registered, within the meaning given by section 1951 of the A New Tax System (Goods and Services Tax) Act 1999; and

 (b) employs less than 20 people.

5  Prescribed program

  For the purposes of subsection 33(1) of the Act, the program specified in item 1 of the following table is prescribed to the extent that it is with respect to the legislative power of the Parliament specified in section 6.

Description and purpose of the program

Cyber Security Small Business Program

Financial assistance to:

(a) assist CREST ANZ to grow the pool of CREST ANZ approved members and to expand its range of cyber security services; and

(b) cofund small businesses to have their cyber security tested by CREST ANZ approved service providers.

6  Specified legislative power

  For the purposes of subsection 33(3) of the Act, the legislative power of the Parliament to make laws with respect to postal, telegraphic, telephonic, and other like services, is specified.
