Migration Amendment (Specification of Occupations) Regulations 2017

Schedule 1—Amendments

Migration Regulations 1994

1  Name

  This instrument is the Migration Amendment (Specification of Occupations) Regulations 2017.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the Migration Act 1958.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Migration Regulations 1994

1  Paragraph 2.72(10)(aa)

After “this paragraph”, insert “and the occupation is applicable to the person identified in the nomination in accordance with the specification of the occupation”.

2  After subregulation 2.72(10)

Insert:

 (10AAA) The Minister may, in an instrument made for the purposes of paragraph (10)(aa), specify any matters for the purposes of specifying the applicability of occupations to identified persons, including (without limitation) matters relating to any of the following:

 (a) the person who nominated the occupation;

 (b) the person identified in the nomination;

 (c) the occupation;

 (d) the position in which the identified person is to work;

 (e) the circumstances in which the occupation is undertaken;

 (f) the circumstances in which the person is to be employed in the position.

3  After paragraph 2.72B(3)(b)

Insert:

 (ba) the occupation is applicable to the nominee in accordance with the specification of the occupation; and

4  After subregulation 2.72B(3)

Insert:

 (3A) The Minister may, in an instrument made for the purposes of paragraph (3)(b), specify any matters for the purposes of specifying the applicability of occupations to nominees as mentioned in paragraph (3)(ba), including (without limitation) matters relating to any of the following:

 (a) the person who nominated the program of occupational training;

 (b) the nominee;

 (c) the occupation;

 (d) the program of occupational training;

 (e) the circumstances in which the occupation is undertaken;

 (f) the circumstances in which the program of occupational training is undertaken.

5  After sub‑subparagraph 5.19(4)(h)(i)(A)

Insert:

 (AAA) the occupation is applicable to the person identified under subparagraph (a)(ii) in accordance with the specification of the occupation;

6  After sub‑subparagraph 5.19(4)(h)(ii)(D)

Insert:

 (DA) the occupation is applicable to the person identified under subparagraph (a)(ii) in accordance with the specification of the occupation;

7  After subregulation 5.19(4)

Insert:

 (4A) The Minister may, in an instrument made for the purposes of sub‑subparagraph (4)(h)(i)(A) or (ii)(D), specify any matters for the purposes of specifying the applicability of occupations to identified persons as mentioned in sub‑subparagraph (4)(h)(i)(AAA) or (ii)(DA), including (without limitation) matters relating to any of the following:

 (a) the nominator;

 (b) the identified person;

 (c) the occupation;

 (d) the position in which the identified person is to work;

 (e) the circumstances in which the occupation is undertaken;

 (f) the circumstances in which the person is to be employed in the position.

8  In the appropriate position in Schedule 13

Insert:

6601  Application of instruments made for purposes of paragraph 2.72(10)(aa)

 (1) This clause applies to an instrument made:

 (a) for the purposes of paragraph 2.72(10)(aa) of these Regulations as amended by Schedule 1 to the Migration Amendment (Specification of Occupations) Regulations 2017; and

 (b) after the Migration Amendment (Specification of Occupations) Regulations 2017 are made.

 (2) The instrument may be expressed to apply in relation to nominations of occupations:

 (a) made on or after the day the instrument commences; or

 (b) made and not finally determined before the day the instrument commences;

regardless of whether, for a nomination in relation to an applicant for a visa, the application was made before, on or after that day.

 (3) If the instrument is expressed to apply in that way, the instrument has effect accordingly.
