1  Name

  This instrument is the VET Student Loans (Charges) Regulations 2017.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the VET Student Loans (Charges) Act 2016.

4  Definitions

Note: The following expressions used in this instrument are defined in the Act:

(a) approved course provider;

(b) approved course provider charge.

  In this instrument:

Act means the VET Student Loans (Charges) Act 2016.

approved course has the same meaning as in the VET Student Loans Act 2016.

census day has the same meaning as in the VET Student Loans Act 2016.

large provider: see section 5.

medium provider: see section 6.

small provider: see section 7.

VET student loan has the same meaning as in the VET Student Loans Act 2016.

5  Large providers

  An approved course provider is a large provider for a financial year if the total number of VET student loans approved for students of the provider by the Secretary for approved courses with at least one census day in the financial year is more than 1,000.

6  Medium providers

  An approved course provider is a medium provider for a financial year if the total number of VET student loans approved for students of the provider by the Secretary for approved courses with at least one census day in the financial year is not less than 200 nor more than 1,000.

7  Small providers

  An approved course provider is a small provider for a financial year if the total number of VET student loans approved for students of the provider by the Secretary for approved courses with at least one census day in the financial year is less than 200.

8  Amount of charge

  For the purposes of paragraph 7(a) of the Act, the prescribed amount of approved course provider charge payable by an approved course provider for a financial year is as follows:

 (a) if the approved course provider is a small provider for the financial year—$1,280;

 (b) if the approved course provider is a medium provider for the financial year—$12,480;

 (c) if the approved course provider is a large provider for the financial year—$62,870.
