This instrument is the Migration (IMMI 17/052: Priority Consideration of Certain Visa Applications) Instrument 2017. It may be cited as IMMI 17/052.
This instrument commences on 1 July 2017.
This instrument is made under subregulation 2.12M(7) of the Regulations.
In this instrument:
Regulations means the Migration Regulations 1994.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Part 2 – Priority Consideration of Visa Application Request – Subclass 600 (Visitor Visa)
6 Priority Consideration of Subclass 600 (Visitor) Visa – Requests Enabled by Application Form
(1) For the purposes of subregulation 2.12(M)(2) of the Regulations, Schedule 1 to this instrument specifies the following matters in relation to making a request for priority consideration of a Subclass 600 (Visitor) Visa:
(a) kinds of visas (Column 1);
(b) kinds of valid passports in relation to kinds of visas specified for the item (Column 2);
(c) requirements in relation to kinds of visas and kinds of valid passports specified for the item (Column 3);
(d) approved application forms in relation to kinds of visas and kinds of valid passports specified for the item (Column 4); and
(e) ways in which applications can be made in relation to kinds of visas, kinds of valid passports and approved forms specified for the item (Column 5)
(2) Schedule 1 applies to requests that are made as permitted by subregulation 2.12M(4) of the Regulations, in accordance with paragraph 2.12M(3)(a) of the Regulations.
Note: Subregulation 2.12M(4) provides that if the approved form for the application enables the making of the request, the request may be made as enabled by the approved form.
7 Priority Consideration of Subclass 600 (Visitor) Visa – Requests Not Enabled By Application Form
(1) For the purposes of subregulation 2.12(M)(2) of the Regulations, Schedule 2 specifies the following matters in relation to making a request for priority consideration of a Subclass 600 (Visitor) visa kinds of visas:
(a) kinds of visas (Column 1);
(b) kinds of valid passports in relation to the kinds of visas specified for the item (Column 2);
(c) approved forms in relation to kinds of visas and kinds of valid passports (Column 3); and
(d) ways in which applications can be made in relation to kinds of visas (Column 5).
(2) For the purposes of subregulation 2.12M(5) of the Regulations, Schedule 2 to this instrument specifies the following matters in relation to making a request for priority consideration as mentioned in paragraph 2.12M(3)(b) of the Regulations:
(a) approved forms in relation to the kind of visa applied for and the kind of valid passport held by the applicant (Column 4); and
(b) ways in which the request must be made in relation to that kind of visa, that kind of valid passport and approved form (Column 5)
(3) Schedule 2 applies to requests that are made using the form approved by the Minister for the purposes of paragraph 2.12M(3)(b).
Note: paragraph 2.12M(3)(b) allows a request to be made by a form approved by the Minister, as an alternative to providing the request in an approved application form that enables the making of the request for priority consideration.
