Part 2—Application of repeals

1  Name

 (1) This instrument is the Migration (IMMI 17/081: Specification of Occupations, a Person or Body, a Country or Countries) Repeal Instrument 2017.

 (2) This instrument may be cited as IMMI 17/081.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the following provisions of the Migration Regulations 1994:

 (a) regulation 1.03;

 (b) subregulation 1.15I(1);

 (c) subregulation 2.26B(1);

 (d) paragraph 2.72(10)(aa);

 (e) paragraph 2.72B(3)(b);

 (f) sub‑subparagraph 5.19(4)(h)(i)(A);

 (g) subitem 1137(4C) of Schedule 1;

 (h) item 4 of the table in subitem 1138(4) of Schedule 1;

 (i) paragraph 1229(3)(k) of Schedule 1;

 (j) item 4 of the table in subitem 1230(4) of Schedule 1;

4  Repeal of this instrument

  This instrument is repealed at the start of 2 July 2017.

5  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  The whole of the instrument

Repeal the instrument.

Part 2—Application of repeals

2  Application of repeals

(1) The repeal made by Part 1 applies in relation to the following:

 (a) a nomination to which IMMI 17/060 applies;

 (b) a nomination to which IMMI 17/071 applies;

 (c) a class of persons to which section 6 of IMMI 17/072 applies;

 (d) an application for approval of a nomination, if subsection 5(1) of IMMI 17/080 applies to the application;

 (e) an application for a Subclass 186 (Employer Nomination Scheme) visa to which subsection 5(2) of IMMI 17/080 applies.

Definition of ANZSCO

(2) Subitem (1) does not apply in relation to the repeal of paragraph 9 of the Specification of Occupations, a Person or Body, a Country or Countries 2016/059.
