Part 2—Transitional provisions

1  Name

  This Ordinance is the Cocos (Keeling) Islands Legislation Amendment (2017 Measures No. 1) Ordinance 2017.

2  Commencement

 (1) Each provision of this Ordinance specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This Ordinance is made under the Cocos (Keeling) Islands Act 1955.

4  Schedules

  Each instrument that is specified in a Schedule to this Ordinance is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Ordinance has effect according to its terms.

Schedule 1Amendments

 

Applied Laws (General) Ordinance 1992

1  Section 1

Omit “Applied Laws (General)”, substitute “Cocos (Keeling) Islands Applied Laws”.

Interpretation Act 1984 (W.A.)(C.K.I.)(Amendment) Ordinance 1992

2  Subsection 5(5)

Insert:

notifiable instrument has the same meaning as in the Legislation Act 2003 of the Commonwealth.

3  Subsection 7(1) (section 74A)

Repeal the section, substitute:

74A  Requirements for publication in Gazette or newspaper

 (1) If an applied law requires or permits a person to publish an instrument in the Gazette or the Government Gazette or in a newspaper circulating in Western Australia, then the requirement must be met, or the permission may only be exercised, by registration of the instrument as a notifiable instrument.

 (2) However, subsection (1) does not apply in relation to an instrument published by or on behalf of Western Australia.

Cooperative Societies Ordinance (of the Colony of Singapore in its application to the Territory)

1  The whole of the Ordinance

Repeal the Ordinance.

Part 2Transitional provisions

2  Definitions

In this Part:

old law means the Cooperative Societies Ordinance (of the Colony of Singapore in its application to the Territory) immediately before the repeal day.

repeal day means the day on which this Schedule commences.

3  Registered societies taken to be registered under WA law

(1) A cooperative society that was, immediately before the repeal day, a registered society under the old law is taken to be registered as a cooperative under the Cooperatives Act 2009 (WA) (CKI) for the period:

 (a) beginning on the repeal day; and

 (b) ending on the day 6 months after the repeal day.

(2) For the purposes of section 21 of the Cooperatives Act 2009 (WA) (CKI), the old law is taken to be the Act under which the cooperative society is registered during the period mentioned in subitem (1).

4  Repeal of this Part

This Part is repealed 6 months after the day on which this Ordinance commences.
