1  Name

  This instrument is the Safety, Rehabilitation and Compensation Legislation (Defence Force) Consequential Amendment Regulations 2018.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the following:

 (a) the Administrative Appeals Tribunal Act 1975;

 (b) the A New Tax System (Goods and Services Tax) Act 1999;

 (c) the Human Services (Medicare) Act 1973;

 (d) the Military Rehabilitation and Compensation (Consequential and Transitional Provisions) Act 2004;

 (e) the Safety, Rehabilitation and Compensation Act 1988.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

4  At the end of section 28

Add:

 (4) The following functions of the Military Rehabilitation and Compensation Commission under the Safety, Rehabilitation and Compensation (Defencerelated Claims) Act 1988 are prescribed functions of the Chief Executive Medicare:

 (a) processing claims for payment relating to the provision of pharmaceutical benefits under that Act;

 (b) making payments of those claims.

5  At the end of paragraph 30(a)

Add “or section 16 of the Safety, Rehabilitation and Compensation (Defencerelated Claims) Act 1988.

6  After paragraph 31(2)(c)

Insert:

 (ca) the Safety, Rehabilitation and Compensation (Defencerelated Claims) Act 1988;

Military Rehabilitation and Compensation (Consequential and Transitional Provisions) Regulations 2004

7  Regulation 3 (note 1 to the definition of Act)

Repeal the note, substitute:

Note 1: A number of expressions used in these Regulations are defined in the Act, including the following:

(a) DRCA;

(b) MRCA.
