1 Name

(1) This instrument is the National Health (Subsection 84C(7)) Amendment Determination 2018 (No. 1).

(2) This instrument may also be cited as PB 47 of 2018.

2 Commencement

This instrument commences immediately after the commencement of the National Health (Pharmaceutical Benefits) Amendment (Safety Net) Regulations 2018.

3 Authority

This instrument is made under subsection 84C(7) of the National Health Act 1953.

4 Amendments

 Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

National Health (Subsection 84C(7)) Determination 2010

1              Section 4 

Insert:

additional patient charge has the same meaning as in the National Health (Pharmaceutical Benefits) Regulations 2017.

2              Subsection 6(1)

Repeal the subsection, substitute:

 (1) For paragraph 84C(8)(d) of the Act, the amounts are as follows:

 (a) for a ready-prepared pharmaceutical benefit, other than an admixed ready‑prepared pharmaceutical benefit - the sum of:

 (i) $1.21; and

 (ii) the amount of the additional patient charge;

 (b) for an extemporaneously-prepared pharmaceutical benefit or an admixed ready-prepared pharmaceutical benefit - the sum of:

 (i) $1.57; and

 (ii) the amount of the additional patient charge.
