Therapeutic Goods Advertising Code 2015 Amendment No. 1 of 2018

I, John Skerritt, a delegate of the Minister for Health for the purposes of section 42BAA of the Therapeutic Goods Act 1989 and acting under that section, hereby amend the Therapeutic Goods Advertising Code 2015 in the manner set out in Schedule 1.

Schedule 1—Amendments

Therapeutic Goods Advertising Code 2015

1  Name

  This instrument is the Therapeutic Goods Advertising Code 2015 Amendment No. 1 of 2018.

2  Commencement

  This Amendment commences on the day after registration of the instrument on the Federal Register of Legislation.

3  Authority

  This instrument is made under section 42BAA of the Therapeutic Goods Act 1989.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

 

Therapeutic Goods Advertising Code 2015

1  6 Minimum requirements, paragraph (3)(e)

Repeal the item, substitute:

(e) or, in the case of Schedule 3 therapeutic goods listed in Appendix H of the current Poisons Standard, either:

(i) words to the effect of:

   YOUR PHARMACIST’S ADVICE IS REQUIRED; or

(ii) the following statement:

ASK YOUR PHARMACIST – THEY MUST DECIDE IF THIS PRODUCT IS RIGHT FOR YOU.
