Schedule 1—Amendments

Business Names Registration Regulations 2011

1  Name

  This instrument is the Business Names Registration Amendment (Delegation and Notified Register) Regulations 2018.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the Business Names Registration Act 2011.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Business Names Registration Regulations 2011

1  Regulation 13

Omit “and 28 (2)”, substitute “, 28(2) and 32(3)”.

2  After regulation 15

Insert:

16  Application and saving provision relating to the Business Names Registration Amendment (Delegation and Notified Register) Regulations 2018

 (1) The amendment made by item 1 of Schedule 1 to the Business Names Registration Amendment (Delegation and Notified Register) Regulations 2018 applies in relation to applications made under subsection 32(3) of the Business Names Registration Act 2011 on or after the commencement of that item.

 (2) The amendment made by item 1 of Schedule 1 to the Business Names Registration Amendment (Delegation and Notified Register) Regulations 2018 does not affect the continuity of any instrument of delegation in force under subsection 80(1) of the Business Names Registration Act 2011 immediately before the commencement of that item.

3  At the end of Schedule 1

Add:

2  After paragraph 4(b) of Schedule 1

Insert:

 (ba) the register of limited partnerships and incorporated limited partnerships established under the Limited Partnerships Act 2016 of Western Australia;
