(1) This instrument is the Migration (LIN 18/077: Supporting Innovation in South Australia Event for Class GG, Subclass 408 (Temporary Activity) Visa) Instrument 2018.
(2) This instrument may be cited as LIN 18/077.
This instrument commences on the day after registration on the Federal Register of Legislation.
This instrument is made under the following provisions of the Regulations:
(a) subregulation 2.07(5);
(b) paragraph 408.229(b) of Schedule 2; and
(c) paragraph 408.229(c) of Schedule 2.
Note: A number of expression used in this instrument are defined in the Regulations, including vocational English (see subregulation 1.15B(1)).
In this instrument:
Regulations means the Migration Regulations 1994.
specified event means the event specified in section 5.
supporting business plan means a written outline of the visa applicant’s plans for the creation of a business directly related to an innovative idea developed through the applicant’s participation in the Supporting Innovation in South Australia event.
temporary activity visa means a Subclass 408 (Temporary Activity) visa in the Class GG (Temporary Activity) visa.
Part 2—Specified event and class of persons
For the purposes of paragraph 408.229(b) of Schedule 2 to the Regulations, the event known as Supporting Innovation in South Australia is specified as an Australian Government endorsed event.
For the purposes of paragraph 408.229(c) of Schedule 2 to the Regulations, an applicant for a temporary activity visa is in a class of persons in relation to the specified event if:
(a) the applicant is under 45 years old at the time of the temporary activity visa application; and
(b) the applicant has vocational English; and
(c) the government of South Australia has endorsed an application for the applicant to participate in the specified event; and
(d) the applicant’s temporary visa application included a supporting business plan.
