Adelaide Airport Curfew Regulations 2018

Adelaide Airport Curfew Regulations 2000
This instrument is the Adelaide Airport Curfew Regulations 2018.
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Adelaide Airport Curfew Act 2000.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Note: A number of expressions used in this instrument are defined in the Act, including the following:
(a) curfew period;
(b) curfew shoulder period;
(c) the Annex;
(d) week.
In this instrument:
Act means the Adelaide Airport Curfew Act 2000.
6 Maximum weekly movements by international aircraft during curfew shoulder periods
For the purposes of section 8 of the Act:
(a) the maximum number of take‑offs by international aircraft that are permitted during the curfew shoulder periods in a week is zero; and
(b) the maximum number of landings by international aircraft that are permitted during the curfew shoulder periods in a week is 8.
7 Maximum weekly movements by low noise heavy freight aircraft during curfew periods
For the purposes of paragraph 10(a) of the Act:
(a) the maximum number of take‑offs by low noise heavy freight aircraft that are permitted during the curfew periods in a week is 15; and
(b) the maximum number of landings by low noise heavy freight aircraft that are permitted during the curfew periods in a week is 25.
For the purposes of subsection 11(1) of the Act, each type of low noise heavy freight aircraft is specified.
9 Types of jet aircraft not affected by curfew periods
(1) For the purposes of subsection 13(2) of the Act, this section specifies types of jet aircraft that may take off or land at Adelaide Airport during a curfew period.
(2) A type of jet aircraft is specified if:
(a) that type satisfies the requirements of paragraphs 13(2)(a), (b) and (c) of the Act; and
(b) a type certificate data sheet, as existing at the commencement of this instrument, with a number and revision number mentioned in an item in the following table, applies to that type of jet aircraft.

(3) However, a type of jet aircraft that does not comply with the maximum noise levels specified in Chapter 4 of the Annex is not specified on and after 1 January 2023 if it is one of the following types:
(a) BAe 125 Series 800A, 800A (C—29A), 800A (U‑125), 800B, 1000A or 1000B;
(b) Beechcraft 400, 400A (Hawker 400 XP) or 400T;
(c) Cessna Citation 650;
(d) Gulfstream G1159, G1159A or G1159B;
(e) HS 125 Series 400B, 400B/1, F600B, 700A or 700B;
(f) Mystere Falcon Series D, E, F or G.
Note: The above aircraft are identified in the type certificate data sheets numbered as follows:
(a) for an aircraft mentioned in paragraph (a) or (e)—A3EU;
(b) for an aircraft mentioned in paragraph (b)—A16SW;
(c) for an aircraft mentioned in paragraph (c)—A9NM;
(d) for an aircraft mentioned in paragraph (d)—A12EA;
(e) for an aircraft mentioned in paragraph (f)—A7EU.
10 Landing on runway other than runway 05 during curfew period—address for giving return
For the purposes of subsection 15(3) of the Act, the address for giving a return is:
