VET Student Loans (Courses and Loan Caps) Amendment Determination (No. 4) 2018

1  Name

  This instrument is the VET Student Loans (Courses and Loan Caps) Amendment Determination (No.4) 2018.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

3  Authority

  This instrument is made under the VET Student Loans Act 2016.

4  Schedule 

  The VET Student Loans (Courses and Loan Caps) Determination 2016 is amended as set out in Schedule 1 to this instrument.

5  Transitional arrangements

  For the avoidance of doubt, if before the commencement of this instrument:

 (a) the Secretary approved a VET student loan for a student for a course of study listed in items 11 or 14 of Schedule 1 to this instrument; and

 (b) the student had not completed the course of study,

the Secretary may continue to pay loan amounts in respect of that loan under section 19 of the VET Student Loans Act 2016 on or after the commencement of this instrument, in relation to that course for that student.

 

 

 

 

Schedule 1 Amendments

 

  1. Subsection 5(1)

Repeal the subsection, substitute:

(1) For paragraph 14(2)(a) of the VET Student Loans Act 2016, the courses for which VET student loans may be approved are:

(a)  the VET courses with the course codes specified in Schedules 1, 2 and 3 to this instrument (each a ‘specified course’);

(b)   any course identified in the National Register as a later version of, or superseding course to, a specified course (‘later version of a specified course’).

 

2.        Subsection 5(1) (note)

Omit “Note” substitute “Note 1”.

3.        At the end of subsection 5(1) (after the note)

Add:

Note 2: Course mapping information about current and earlier versions of VET courses is included in the National Register.

4.        Subsection 5(2)

After “Schedule 3 to this instrument” insert “or any later version of a specified course”.

5.        Paragraph 5(3)(a)

After Part 1 of Schedule 1 insert “or any later version of a specified course”.

6.        Paragraph 5(3)(b)

After “Part 2 of Schedule 1 insert “or any later version of a specified course”.

7.        Paragraph 5(3)(c)

After Part 3 of Schedule 1 insert “or any later version of a specified course”.

8.        Paragraph 5(3)(d)
