1  Name

  This instrument is the Air Services Legislation (Repeal and Consequential Amendments) Regulations 2019.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the Air Services Act 1995.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  The whole of the instrument

Repeal the instrument.

2  Subsection 4(1) (definition of Aeronautical Information Publication)

Omit “Air Services Regulations 1995”, substitute “Air Services Regulations 2019”.

3  Subsection 4(1) (definition of Aeronautical Information Service)

Repeal the definition.

4  Subsection 4(1) (definition of Notice to Airmen)

Omit “Air Services Regulations 1995”, substitute “Air Services Regulations 2019”.

5  Paragraph 18(5)(b)

Omit “the Aeronautical Information Service”, substitute “Airservices Australia”.

Airspace Regulations 2007

6  Regulation 3 (definition of Aeronautical Information Publication or AIP)

Repeal the definition.

7  Regulation 3

Insert:

AIP (short for Aeronautical Information Publication) has the same meaning as in the Air Services Regulations 2019.

8  Regulation 3 (definition of air traffic services)

Repeal the definition, substitute:

air traffic services has the same meaning as in the Air Services Regulations 2019.

Insert:

NOTAM (short for Notice to Airmen) has the same meaning as in the Air Services Regulations 2019.

Repeal the definition.

Repeal the definition.

17  Part 1 of the Dictionary

Insert:

Aeronautical Information Publication or AIP has the same meaning as in the Air Services Regulations 2019.

Repeal the definition, substitute:

AIP: see Aeronautical Information Publication.

Repeal the definition.

Insert:

23  Regulation 2.2 (definition of control area)

Repeal the definition.

24  Regulation 2.2 (definition of controlled airspace)

Repeal the definition, substitute:

controlled airspace means:

 (a) airspace determined to be a control zone under paragraph 5(1)(b) of the Airspace Regulations 2007; or

 (b) airspace determined to be a control area under paragraph 5(1)(c) of the Airspace Regulations 2007.
