1 Name

  This instrument is the Education Services for Overseas Students (ASQA Registration Renewal Application Period) Determination 2019.

2 Commencement

(1)    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority

  This instrument is made under subsection 10D (3) of the Education Services for Overseas Students Act 2000.

4 Definitions

Note: A number of expressions used in this instrument are defined in section 5 of the Act, including the following:

(a) ESOS agency;

(b) National VET Regulator;

(c) registered provider;

(d) registered VET provider;

  In this instrument:

Act means the Education Services for Overseas Students Act 2000.

5 Periods within which renewal of registration must be made

 (1) Applications made by a registered provider to the Australian Skills Quality Authority (ASQA), being the National VET Regulator and ESOS Agency for registered VET providers, for renewal of registration under subsection 10D(1) of the ESOS Act, must be made:

(a) at least 90 days prior to the date on which a registered provider’s registration is due to expire; or

(b) within such shorter period as ASQA allows.
