Schedule 1—Amendments to the VET Student Loans Rules 2016

 

1  Name

  This instrument is the VET Student Loans Amendment Rules (No. 1) 2019.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Part 1Separation of VET student loan debts from HELP debts

 

1  Paragraph 23(3)(d)

After “HELP debts”, insertor VETSL debts”.

2  Paragraph 98(2)(j)

Omit “HELP debt”, substitute “VETSL debt”.

3  Subparagraph 98(2)(l)(iii)

Omit “VET student loan debt”, substitute “VETSL debt”.

4  Subparagraph 99(4)(m)(ii)

Omit “HELP debt”, substitute “VETSL debt”.

Part 2Miscellaneous amendments

9  After paragraph 80(2)(a)

Insert:

(aa) the provider obtains a copy of a diploma that has been awarded to the student for the student’s completion of the International Baccalaureate Diploma Programme; or

10  Subparagraph 80(2)(c)(i)

Repeal the subparagraph, substitute:

(i)                  the provider obtains a copy of a certificate (however described) that the student has been awarded a qualification, either:

  1. at level 4 or above in the Australian Qualifications Framework or at a level in a framework that preceded the Australian Qualifications Framework that is equivalent to level 4 or above in the Australian Qualifications Framework; or
  2. that has been assessed by a Federal, State or Territory government agency which assesses overseas qualifications (or an organisation contracted by such an agency to undertake such assessments) as equivalent or comparable to a qualification referred to in sub-subparagraph (2)(c)(i)(A).

11  Paragraph 116(1)(d)

Repeal the paragraph.

12  Paragraph 116(1)(e)

Repeal the paragraph.

13  Paragraph 116(1)(f)

Repeal the paragraph, substitute:

(f) the proposed census days for each of the approved courses offered by the provider;

14  Paragraph 116(1)(i)

Repeal the paragraph, substitute:

(i)                  the tuition fees for each approved course to be offered by the provider in the next financial year;

15  Paragraph 116(1)(k)

Repeal the paragraph.
