Determination under paragraph (c) of the definition of “broadcasting service” (No. 1 of 2000)
This instrument is the Broadcasting Services (“Broadcasting Service” Definition — Exclusion) Determination 2019.
This instrument commences on the day after it is registered.
This instrument is made under subsection 6(2) of the Broadcasting Services Act 1992.
Note: A number of expressions used in this instrument are defined in section 6 of the Act, including the following:
(a) broadcasting service;
(b) broadcasting services bands;
(c) program;
(d) radio program.
In this instrument:
Act means the Broadcasting Services Act 1992.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
6 Exclusion from the definition of “broadcasting service”
For the purposes of paragraph (c) of the definition of “broadcasting service” in subsection 6(1) of the Act, the following class of services does not fall within that definition:
(a) a service that makes available television programs or radio programs using the internet, other than a service that delivers television programs or radio programs using the broadcasting services bands.
This instrument is repealed the day after the end of the period of 36 months beginning on the day this instrument commences.
