Part 1 – Preliminary

1  Name

1.            This instrument is the Migration (LIN 20/007: Payment of Visa Application Charges and Fees in Foreign Currencies) Amendment Instrument 2020.
2.            This instrument may be cited as LIN 20/007.

2  Commencement

This instrument commences immediately following the commencement of Migration (LIN 20/001: Payment of Visa Application Charges and Fees in Foreign Currencies) Instrument 2020.

3  Authority

This instrument is made under paragraph 5.36(1A)(a) of the Regulations.

4  Schedule

The instrument that is specified in Schedule 1 to this instrument is amended as set out in the applicable items in that Schedule.

Schedule 1—Amendments

Migration (LIN 20/001: Payment of Visa Application Charges and Fees in Foreign Currencies) Instrument 2020

1  Section 3 – Authority

Omit “paragraphs 5.36(1)(a) and (b), and”, substitute “paragraph”.  

2  Section 4 – Definitions

Repeal “foreign country has the meaning defined in section 2B of the Acts Interpretation Act 1901”.

3  Section 5 – Schedules

Omit the section, substitute:

Each instrument that is specified in a Schedule to this instrument is repealed as set out in the applicable items in that Schedule, and any other item in a Schedule to this instrument has effect according to its terms.

4  Part 2, section 6 – Places and foreign currencies for payment of VAC and fees

Omit the section, substitute:

6  Exchange rates for payment of VAC and fees in foreign currencies

For the purposes of paragraph 5.36(1A)(a) of the Regulations, the exchange rate for the currency specified in Column A of an item in the table in Schedule 1, in which the payment of a VAC or a fee is to be paid, is specified in Column C for that item, with the corresponding ISO code mentioned in Column B for that item.

Note: Payment of a VAC mentioned in this Part does not include a VAC mentioned in subregulation 5.36(3A) of the Regulations.

5  Part 2, section 7 –  Exchange rates for payment of VAC and fees in foreign currencies

Repeal the whole section.

6  Schedule 1

Repeal the whole Schedule.

7  Schedule 2

Omit the title, substitute:

Schedule 1 — Exchange Rates for the Payment of VAC and Fees in Foreign Currencies

8  Schedule 3

Omit the title, substitute:

Schedule 2 – Repeals
