CASA EX26/20 — Electronic Surveillance Equipment Fitted to Vehicles Exemption 2020

1 Name

 This instrument is CASA EX26/20 — Electronic Surveillance Equipment Fitted to Vehicles Exemption 2020.

2 Duration

 This instrument:

(a) commences on 1 February 2020; and

(b) is repealed at the earlier of the following:

 (i) the commencement of the Civil Aviation Safety Amendment (Part 139) Regulations 2019;

 (ii) the end of 31 January 2023.

3 Definitions

Note   In this instrument, certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include: aerodrome and aerodrome operator.

 In this instrument:

A-SMGCS has the meaning given by regulation 139.251 of CASR.

multilateration system means a group of equipment:

(a) configured to provide position derived from the secondary surveillance radar transponder signals (replies or squitters) primarily using time difference of arrival techniques; and

(b) from which additional information, including identification, can be extracted from the received signals.

4 Application

 (1)Subject to subsection (2), this instrument applies in relation to the aerodrome operator of an aerodrome that is designated, under regulation 139.252 of CASR, as an aerodrome to which ASMGCS applies.

 (2)This instrument only applies if the following requirements are met:

(a) the A-SMGCS at the aerodrome uses surface movement radar, or a multilateration system, as the primary source of position information about activities within the runway strip of the aerodrome;

(b) the aerodrome operator complies with regulation 139.254 of CASR, as if the reference in subparagraph 139.254 (3) (a) (i) of CASR to “meets the technical standards for the equipment published in the Manual of Standards” were a reference to “is one of the following:

 (i) the Saab Sensis VeeLo NextGen;

 (ii) the ERA a.s. Squid.

5 Exemption

 The aerodrome operator is exempt from compliance with regulation 139.254 of CASR to the extent that it requires the establishment of, and compliance with, procedures that require a vehicle that enters, or moves on, the aerodrome’s manoeuvring area to be fitted with serviceable electronic surveillance equipment that meets the technical standards prescribed in Table 10.91 of paragraph 10.9.4.1 of the Manual of Standards (MOS) Part 139 Aerodromes (the MOS).

Note   Regulation 139.254 of CASR requires an operator of a certified aerodrome, that is designated as an aerodrome to which A-MGCS applies, to establish procedures that require any vehicle that enters, or moves on, the aerodromes manoeuvring area to be fitted with serviceable electronic surveillance equipment that meets the technical standards for the equipment published in the MOS.
