This instrument is the Industry Research and Development (International Space Investment Initiative Program) Instrument 2020.
This instrument is made under section 33 of the Industry Research and Development Act 1986.
In this instrument:
Act means the Industry Research and Development Act 1986.
program means the International Space Investment Initiative Program.
relevant overseas organisation means any of the following:
(a) a foreign government;
(b) an agency or organisation of a foreign government;
(c) an intergovernmental organisation;
(d) a foreign organisation or business.
(1) For the purposes of subsection 33(1) of the Act, the program is prescribed.
(2) The program provides funding:
(a) to Australian organisations and businesses to enable them to do either or both of the following:
(i) to participate in international space projects with relevant overseas organisations;
(ii) to supply, or contribute (whether directly or indirectly) to supplying, goods and services that will be used by relevant overseas organisations for the purposes of international space projects; and
(b) to relevant overseas organisations to enable them to do either or both of the following:
(i) to participate in international space projects with Australian organisations and businesses;
(ii) to purchase goods and services from Australian organisations and businesses for the purposes of international space projects.
(3) Without limiting subsection (2), the purposes of the program include the following:
(a) to enable Australian organisations and businesses to participate in international space projects with relevant overseas organisations;
(b) to encourage scientific and technical collaboration between Australian organisations and businesses and relevant overseas organisations;
(c) to increase Australia’s participation in the global space industry.
For the purposes of subsection 33(3) of the Act, the powers of the Parliament to make laws with respect to the following are specified:
(a) trade and commerce with other countries, and among the States (within the meaning of paragraph 51(i) of the Constitution);
(b) external affairs (within the meaning of paragraph 51(xxix) of the Constitution);
(c) the government of a Territory (within the meaning of section 122 of the Constitution);
(d) measures that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation.

A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under section 15V of the Legislation Act 2003.
If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.
