1  Name

  This instrument is the Australian Hearing Services (Declared Hearing Services) Amendment Determination 2020.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under section 8 of the Australian Hearing Services Act 1991.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Australian Hearing Services (Declared Hearing Services) Determination 2019

1  Subsection 4(1) (definition of NDIS)

Repeal the definition.

2  Subsection 4(1) (definition of parent)

Omit “young NDIS participant” (wherever occurring), substitute “young Disability Services Act 1993 (WA) participant”.

3  Subsection 4(1) (definition of young NDIS participant)

Repeal the definition.

4  Subsection 4(1)

Insert:

young Disability Services Act 1993 (WA) participant means a person who:

 (a) is under 26 years of age; and

 (b) is a participant within the meaning of the Disability Services Act 1993 (WA) and has been referred to the Authority in connection with the funding or provision of supports under the participant’s plan under section 26I of that Act.

5  Section 6 (table item dealing with class 1, column headed “Persons to receive the hearing services”)

Omit “young NDIS participant”, substitute “young Disability Services Act 1993 (WA) participant”.

6  Section 6 (table item dealing with class 5, column headed “Persons to receive the hearing services”)

Omit “young NDIS participant”, substitute “young Disability Services Act 1993 (WA) participant”.

7  Section 6 (table item dealing with class 5, column headed “Declared hearing services”)

Omit “young NDIS participant”, substitute “young Disability Services Act 1993 (WA) participant”.

8  After section 9

Insert:

10 Transitional

A person who was a member of class 5 on 30 June 2020 by virtue of being a young NDIS participant immediately before turning 26, is taken to continue to be in class 5 of this instrument for the period of 5 years beginning on the day the person turned 26.
