1  Name

  This instrument is the Social Security (Coronavirus Economic Response—2020 Measures No. 11) Determination 2020.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under item 40A of Schedule 11 to the Coronavirus Economic Response Package Omnibus Act 2020.

4  Modifications

  Each modification of the operation of a provision of a social security law (within the meaning of the Social Security Act 1991) as set out in a Schedule to this instrument is determined for the purposes of item 40A of Schedule 11 to the Coronavirus Economic Response Package Omnibus Act 2020.

Schedule 1Modifications of the Social Security Act 1991

 

1  Variation of section 23

(1) Subsection 23(4A) of the Social Security Act 1991 is varied by:

 (a) inserting the words “, or a social security pension or social security benefit is payable to a person” after the word “benefit” in paragraph (a); and

 (b) inserting the words “, or the pension or benefit is taken to be payable to the person,” before the word “until”.

(2) Subsection 23(4AA) of the Social Security Act 1991 is varied by inserting the following paragraph after paragraph (d):

 (da) subsection 1061ZA(1);

(3) Section 23 of the Social Security Act 1991 is varied by inserting the following subsections after subsection (4AA):

 (4AB) If:

 (a) the cessation day occurs before the extension day; and

 (b) the 12week period referred to in paragraph (4A)(h) would, but for this subsection, end between the extension day and 2 August 2020;

then the reference in that paragraph to 12 weeks after the end of the instalment period in which the cessation day occurs is taken to be a reference to 2 August 2020.

 (4AC) For the purposes of subsection (4AB), extension day means the day after the Social Security (Coronavirus Economic Response—2020 Measures No. 11) Determination 2020 commences.

Schedule 2Modifications of the Social Security (Administration) Act 1999

 

1  Variation of section 96

(1) Section 96 of the Social Security (Administration) Act 1999 is varied by inserting the following subsection after subsection (2):

 (2A) If:

 (a) disability support pension ceases to be payable to a person because the rate of the pension is nil as a result of an increase in the person’s ordinary income; and

 (b) the increase is as a result of the income, or increased income, earned by the person’s partner from his or her employment;

the Secretary may determine:

 (c) that section 93 does not apply to the person’s disability support pension; and

 (d) that the person’s disability support pension is to be suspended.

(2) Paragraph 96(3A)(a) is varied by omitting the words “or (3)” and substituting the words “, (2A) or (3)”.

(3) Paragraph 96(4)(a) is varied by omitting the words “or (3)” and substituting the words “, (2A) or (3)”.
