1  Name

  This instrument is the Export Control Legislation Amendment (Certification of Narcotic Exports) Order 2020.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

Immediately after the commencement of the Export Control Legislation Amendment (Certification of Narcotic Exports) Act 2020.

  This instrument is made under the Export Control (Orders) Regulations 1982.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

 

Export Control (Plants and Plant Products) Order 2011

1  Paragraph 3(e)

After “plants or plant products”, insert “(other than narcotic goods)”.

2  Section 5

Insert:

narcotic goods has the same meaning as in the Customs Act 1901.

Export Control (Prescribed Goods—General) Order 2005

3  Subsection 1.05(1)

Insert:

narcotic goods has the same meaning as in the Customs Act 1901.

4  Paragraph 1.07(1)(b)

Omit “pharmaceutical material”, substitute “pharmaceutical material (other than narcotic goods)”.

5  Subsection 2.01(4)

After “Neither this Order”, insert “(other than Part 8)”.

6  Paragraph 8.04(1)(a)

Repeal the paragraph, substitute:

 (a) if an Export Control Order that applies to the goods requires a permit to export the goods—the permit has not been issued; or
