Bankruptcy (Fees and Remuneration) Determination 2015

1  Name

  This instrument is the Bankruptcy (Fees and Remuneration) Amendment (Consequential Amendments) Determination 2021.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under subsection 316(1) of the Bankruptcy Act 1966.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Omit “Regulations”, substitute “Bankruptcy Regulations 1996”.

2  Subsection 1.05(1) (definition of Regulations)

Omit “1996”, substitute “2021”.

3  Subsection 1.05(2) (note 2)

Repeal the note, substitute:

Note 2: Index means the National Personal Insolvency Index established under section 73 of the Regulations.

Omit “subregulation 13.06(1)”, substitute “subsection 84(2)”.

Omit “subregulation 13.06(3)”, substitute “subsection 84(3)”.

Omit “4.02A (b)”, substitute “10(1)(b)”.

7  Subsection 2.11(1)

Omit “to the Official Trustee for consent to leave Australia under regulation 5.02 of the Bankruptcy Regulations 1996”, substitute “of a kind mentioned in subsection 110(1) of the Regulations”.
