This instrument is the Defence Determination, Conditions of service Amendment Determination 2021 (No. 6).

2  Commencement

 

1.

Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under section 58B of the Defence Act 1903.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Higher Duties Allowance amendments

Defence Determination 2016/19, Conditions of service

 

Omit “within the ADF”.

 

Omit “a Defence APS position”, substitute “an APS position”.

 

Omit the section, substitute:

 

The following members are not eligible for higher duties allowance.

 

a.

A trainee or member undergoing training.

 

b.

A member who is an Aviation Specialist.

 

c.

A member in the Navy or Air Force, who is in the Specialist Pathway of the Officer Aviation Pay Structure.

 

b.

Statutory office holders.

 

e.

A member holding a rank in an item column A of the following table, who has been directed to perform the higher duties at the rank or salary proficiency point described in column B of the same item.

A period where a member has been directed to perform higher duties for less than 10 consecutive days.

If the member has been posted to the position in which the higher duties is being performed the duration of the member’s posting to that position.

 

 

ii.

If subparagraph i does not apply 12 months.

 

Schedule 2—Leave for travel to restricted destinations amendments

Schedule 5—Rent allowance amendments

1.

In this Part, a member is not sharing a home with a person they live with if the person meets one of the following and the person is not a subtenant.

 

a.

The person is a dependant.

 

b.

A resident child carer.

Note: A resident child carer is defined in section 7.1.14.

 

c.

The person is less than 18 years old.

 

d.

The person was living with the member before they turned 18 years old and any of the following apply.

 

 

i.

They are not a lessee of the property.

 

 

ii.

The member’s lease on the property has not ended since the person turned 18 years old.

 

 

iii.

The member has not had a removal under section 6.5.26 or section 6.5.27 since the person turned 18 years old. 

 

Note: This definition does not affect the calculation of rent allowance for a member categorised as a member with dependants.

2.

Paragraphs 1.c and 1.d only apply from one of the following days.

 

a.

The day the member notifies DHA that the person meets the criteria of the relevant paragraph.

 

b.

The day the person starts to live in the member’s home if all of the following apply.

 

 

i.

The member is deployed, on a seagoing ship, submarine or flight, or receiving field allowance at the time the person starts to live in the member’s home.

 

 

ii.

The member notifies DHA that the person meets the criteria of the relevant paragraph.

 

 

iii.

The notification under subparagraph ii occurs within 30 days of the member ceasing to be deployed, on a seagoing ship, submarine or flight, or receiving field allowance, but not earlier than 5 August 2021.

 

Note: This section may apply to person visiting the member who is considered a resident under subsection 7.8.20.3.

Schedule 7—Transitional provisions

1.

This section applies to a member who was deployed on Operation AUGURY on any day between 1 December 2020 and the commencement of this Determination and meets both of the following.

 

a.

The member performed duty in Iraq or Syria as part of Operation AUGURY.

 

b.

The member did not receive deployment allowance for any day of duty performed in the operational area during the period in subsection 1.

2.

The member is eligible for AUD 166.44 for each day of duty the member met the conditions set out in subsection 1.
