Schedule 1—Amendments
Financial Framework (Supplementary Powers) Regulations 1997
This instrument is the Financial Framework (Supplementary Powers) Amendment (Agriculture, Water and the Environment Measures No. 3) Regulations 2021.
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Financial Framework (Supplementary Powers) Act 1997.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Financial Framework (Supplementary Powers) Regulations 1997
1 Part 4 of Schedule 1AB (table item 368, column headed “Objective(s)”)
Omit all the words after “farming practices.”, substitute:
This objective has the effect it would have if it were limited to measures:
(a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or
(b) to give effect to Australia’s obligations under either or both of the following:
(i) the Convention on Biological Diversity, particularly Articles 6, 8, 10, 11 and 12;
(ii) the United Nations Convention to Combat Desertification in those Countries Experiencing Serious Drought and/or Desertification, Particularly in Africa, particularly Articles 5 and 10; or
(c) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or
(d) in the exercise of the executive power of the Commonwealth; or
(e) undertaken in, or in relation to, a Territory.
2 In the appropriate position in Part 4 of Schedule 1AB (table)
Insert:
487 | Blue Carbon Ecosystems | To support: (a) projects in regional Australia and in foreign countries that relate to restoring coastal ecosystems and demonstrating environmental economic accounting; and (b) international events and partnerships relating to blue carbon and rainforests. This objective has the effect it would have if it were limited to measures: (a) to give effect to Australia’s obligations under one or more of the following: (i) the Convention on Biological Diversity, particularly Articles 6 and 8; (ii) the Kyoto Protocol to the United Nations Framework Convention on Climate Change, particularly Article 10; (iii) the Paris Agreement, particularly Article 10; (iv) the United Nations Framework Convention on Climate Change, particularly Article 4; or (b) relating to places, persons, matters or things external to Australia or matters affecting Australia’s relations with foreign countries. |
488 | Australian Farm Data Code | To modify, expand, implement, and raise awareness of, the Australian Farm Data Code as a measure with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution). |
489 | AgCAREERSTART, AgUP and Modern Workforce Management and Planning Practices Project | To assist in shifting perceptions of agriculture, improve the reputation of the agricultural sector as an employer, and build workforce management and planning skills, including by: (a) supporting a pilot initiative to provide school leavers with the opportunity to work in agriculture by undertaking a placement at a farm and relevant training; and (b) providing grants for industry‑led initiatives to provide opportunities for upskilling and career progression; and (c) supporting agricultural employers to implement best practice modern workforce management and planning practices. This objective has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) to give effect to Australia’s obligations under one or more of the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 6; (ii) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; (iii) the International Labour Organization’s Convention concerning Vocational Guidance and Vocational Training in the Development of Human Resources, particularly Articles 1 to 4. |
