Schedule — exceptional circumstances provision

 

1  Name

  This instrument is the Health Insurance (Section 3C – Allied Health Services) Amendment (Case Conference Exceptional Circumstance) Determination 2021.

2  Commencement

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under subsection 3C(1) of the Health Insurance Act 1973.

Schedule exceptional circumstances provision

Health Insurance (Allied Health Services) Determination 2014

  1. Subsection 15(3)

After “months’, insert “, unless in exceptional circumstances”.

2.     After subsection 15(3)

Insert:

(3A) For subsection (3), exceptional circumstances means there has been a significant change in the patient’s clinical condition or care circumstances that necessitates the performance of the service.
