Migration (ICC Men's T20 World Cup 2022 and FIFA Women's World Cup 2023—AGEEs) Instrument (LIN 21/049) 2021

I, Sandra Jeffery, delegate of the Minister, make this instrument under subregulation 2.07(5), subparagraph 1237(2)(a)(i) of Schedule 1 and paragraphs 408.229(b) and (c) of Schedule 2 to the Migration Regulations 1994 (the Regulations).

1 Name

 This instrument is the Migration (ICC Men's T20 World Cup 2022 and FIFA Women's World Cup 2023—AGEEs) Instrument (LIN 21/049) 2021.

2 Commencement

 This instrument commences on 13 November 2021.

3 Definitions

 In this instrument:

2023 FWWC entity means the central entity for the operational delivery of the tasks, activities and sub-projects for the competition by FIFA and Football Australia (ABN: 74 650 853 302).

competition means the FIFA Women’s World Cup 2023 tournament matches and competition-related events.

competition organiser means any of the following:

(a) FIFA;

(b) the 2023 FWWC entity;

(c) Football Australia (ABN: 28 106 478 068);

(d) New Zealand Football. 

competition-related event means an event or activity that:

(a) is officially organised, supported, sanctioned or endorsed by, or under the auspices of, a competition organiser; and

(b) is related to the FIFA Women’s World Cup 2023; and

(c) is designed to promote, celebrate, enhance or facilitate the hosting and staging of the tournament; and

(d) includes any of the following:

 (i) the draw, banquets, opening, closing, award and other ceremonies;

 (ii) media and marketing events, including press conferences and launch activities;

 (iii) seminars, meetings, conferences and workshops;

 (iv) official public viewing and other fan-related events, including the FIFA Fan Experience;

 (v) cultural activities or events, including concerts, exhibitions, displays, shows and other expressions of culture;

 (vi) sustainability activities, including events, activities or programs developed by FIFA that promote sustainable event management or sustainable development and contribute to FIFA’s mission to building a better future;

 (vii) other football matches and training sessions;

 (viii) other activities that a competition organiser considers relevant for the staging, organisation, preparation, marketing, promotion or winding-up of the competition.

FIFA confederation means any of the following:

(a) Asian Football Confederation;

(b) Confederation Africaine de Football;

(c) Confederation of North, Central American and Caribbean Association Football;

(d) Confederacion Sudamericana de Futbol;

(e) Oceania Football Confederation;

(f) Union des Associations Europeennes de Football.

FIFA means the Federation Internationale de Football Association.

FIFA subsidiary means the following entities:

(a) an entity in which FIFA, directly or indirectly, owns at least 50.1% capital or voting interest (a first entity);

(b) an entity that is a subsidiary of a first entity in which FIFA or the first entity owns at least 50.1% of the capital or voting interest.

Note This may include the 2023 FWWC entity.

FIFA Women’s World Cup 2023 means the FIFA Women’s World Cup cohosted by Australia and New Zealand in 2023.

ICC means the International Cricket Council.

ICC Men’s T20 World Cup 2022 means the ICC Men’s Twenty20 World Cup hosted by Australia in 2022.

T20 World Cup 2020 Ltd means the local organising committee appointed by Cricket Australia for the operational delivery of the ICC Men’s T20 World Cup 2022 (ABN: 14 618 113 269).

4 Events

 For paragraph 408.229(b) of Schedule 2 to the Regulations, the following events are specified:

(a) FIFA Women’s World Cup 2023;

(b) ICC Men’s T20 World Cup 2022.  

5 Class of persons—FIFA Women’s World Cup 2023

 For paragraph 408.229(c) of Schedule 2 to the Regulations, an applicant for a Subclass 408 visa is in a class of persons for the event mentioned in paragraph 4(a) if, at the time of application, the applicant is:

(a) approved for accreditation by the 2023 FWWC entity as a participant in the competition; and

(b) endorsed in writing by the 2023 FWWC entity as a participant in the competition; and

(c) any of the following persons:

 (i) FIFA staff or official;

 (ii) 2023 FWWC entity staff or official;

 (iii) FIFA subsidiary staff or official;

 (iv) FIFA delegation member, including match official;

 (v) FIFA contractor staff;

 (vi) FIFA confederation staff or official;

 (vii) FIFA member association staff or official;

 (viii) volunteer;

 (ix) media representative;

 (x) FIFA listed individual accredited by the 2023 FWWC entity to attend the competition.

6 Class of persons—ICC Men’s T20 World Cup 2022

 For paragraph 408.229(c) of Schedule 2 to the Regulations, an applicant for a Subclass 408 visa is in a class of persons for the event mentioned in paragraph 4(b) if, at the time of application, the applicant is:

(a) approved for accreditation by the T20 World Cup 2020 Ltd, in conjunction with the ICC, as a participant in the ICC Men’s T20 World Cup 2022; and

(b) endorsed in writing by the T20 World Cup 2020 Ltd as a participant in the ICC Men’s T20 World Cup 2022; and

(c) any of the following persons:

 (i) employee of ICC Business Corporation FZ-LLC;

 (ii) ICC chairman, ICC chief executive, a member of the ICC board of directors or ICC executive;

 (iii) spouse or de facto partner of the ICC chairman, ICC chief executive, member of the ICC board of directors or ICC executive;

 (iv) ICC staff including agent or representative of the ICC;

 (v) invited guest of the ICC;

 (vi) member of the ICC Anti-Corruption Unit;

 (vii) ICC committee member;

 (viii) official event observer;

 (ix) member of a competing team, including a player, coach, medical personnel, team management or team official;

 (x) match official, including an umpire or a referee;

 (xi) personnel from the host broadcaster or a rights holder;

 (xii) media personnel of a non-rights holder;

 (xiii) person who is approved for accreditation by the ICC or T20 World Cup 2020 Ltd as agreed by the Government of Australia.

7 Visa application charge

For subsection 2.07(5) and subparagraph 1237(2)(a)(i) of Schedule 1 to the Regulations, sections 5 and 6 specify the classes of persons to whom the visa application charge amount is nil.  

8 Repeal

 (1)Migration (Classes of Persons and Specified Events for Class GG visa and Subclass 408 (Temporary Activity) visa) Instrument 2019/231 is repealed.

 (2)This instrument is repealed on 24 August 2023.
