1  Name of instrument

  This instrument is the Woomera Prohibited Area Amendment Rule (No.1) 2021.

2  Commencement

  (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under subsection 72TP(1) of the Defence Act 1903.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

 

Woomera Prohibited Area Rule 2014

1. Subsection 63(1)

Repeal the subsection, substitute:

(1)      The Minister, by writing, may delegate his or her powers or functions under  section 62 to review decisions (other than a decision under section 38 or 41) to:

(a)      the Secretary; or

(b)      an APS employee who holds or performs the duties of an SES Band 2 position, or an equivalent or higher position, in the Department.

2   Subsection 63(2)

Repeal the subsection, substitute:

             (2)  The Minister, by writing, may delegate his or her powers or functions under this rule (other than the Minister’s powers or functions under section 62 to review decisions) to:

(a)   the Secretary; or

(b)      an APS employee who holds or performs the duties of an Executive Level 1 position, or an equivalent or higher position, in the Department; or

(c)   an officer of the Navy who holds the rank of Commander or a higher rank; or

(d)   an officer of the Army who holds the rank of LieutenantColonel or a higher rank; or

(e)   an officer of the Air Force who holds the rank of Wing Commander or a higher rank.
