1  Name

  This instrument is the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under subregulation 2.26B(1) of the Migration Regulations 1994.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Migration (LIN 19/051: Specification of Occupations and Assessing Authorities) Instrument 2019

1  Subsection 8(1) (table item 2, column 3, paragraph (b))

Omit “AIM”, substitute “IML”.

2  Section 9

Before “The occupations”, insert “(1)”.

3  Section 9 (table items 6, 7, 10 and 16, column 3)

Omit “AIM”, substitute “IML”.

4  Section 9 (table item 66, column 3)

Omit “VETASSESS”, substitute “the assessing authority for the occupation under subsection (2)”.

5  At the end of section 9

Add:

 (2) For the purposes of item 66 of the table in subsection (1), the assessing authority is:

 (a) for an information and organisation professional (nec) other than a data scientist—VETASSESS; and

 (b) for an information and organisation professional (nec) that is a data scientist—ACS.

6  Subsection 10(1) (table items 18 and 21, column 3)

Omit “AIM”, substitute “IML”.

7  Section 11 (table item 7)

Repeal the item.

8  Section 11 (table item 8, column 2)

15  Amendments made by the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022

 (1) This section applies to an application for:

 (a) a Subclass 189 (Skilled—Independent) visa; or

 (b) a Subclass 190 (Skilled—Nominated) visa; or

 (c) a Subclass 485 (Temporary Graduate) visa; or

 (d) a Subclass 491 (Skilled Work Regional (Provisional)) visa;

made on or after the day (the commencement day) the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022 commences.

New assessing authorities specified for visa applications made on or after commencement day regardless of when application for skills assessment is made

 (2) The amendments of this instrument made by Schedule 1 to the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022 apply in relation to an application for a visa to which this section applies, whether the application for the skills assessment in relation to the application for the visa was made before, on or after the commencement day.

Previous assessing authorities also specified for visa applications made on or after commencement day if application for skills assessment is made before commencement day

 (3) For the purposes of subregulation 2.26B(1) of the Regulations, a person or body listed in column 2 of an item of the following table is also specified as the relevant assessing authority for:

 (a) the skilled occupation listed in column 1 of the item; and

 (b) all countries;

for the purposes of an application for a skills assessment made by a resident of one of those countries in relation to an application for a visa to which this section applies, if the application for the skills assessment is made before the commencement day.
