1  Name

  This instrument is the Migration (Assessing Authorities for Subclass 494 Visas) Amendment Instrument (LIN 22/054) 2022.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under subclause 494.224(6) of Schedule 2 to the Migration Regulations 1994.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  Subsection 6(1) (table items 1 and 2, column 2)

Omit “AIM”, substitute “IML”.

2  Subsection 6(1) (table item 4, column 2, paragraph (b))

Omit “AIM”, substitute “IML”.

Omit “ACWA”, substitute “ACS”.

Omit “AIM”, substitute “IML”.

Omit “VETASSESS”, substitute “the assessing authority for the occupation under subsection (3)”.

Add:

 (3) For the purposes of item 141 of the table in subsection (1), the assessing authority is:

 (a) for an information and organisation professional (nec) other than a data scientist—VETASSESS; and

 (b) for an information and organisation professional (nec) that is a data scientist—ACS.

Note: For the meaning of VETASSESS and ACS, see section 9.

7  Section 9 (table item 8)

Repeal the item.

10  Amendments made by the Migration (Assessing Authorities for Subclass 494 Visas) Amendment Instrument (LIN 22/054) 2022

New assessing authorities specified for visa applications made on or after commencement regardless of when application for assessment is made

 (1) The amendments of this instrument made by Schedule 1 to the Migration (Assessing Authorities for Subclass 494 Visas) Amendment Instrument (LIN 22/054) 2022 (the amending instrument) apply in relation to an application for a Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa:

 (a) if the application is made on or after the day the amending instrument commences; and

 (b) regardless of whether the application for the skills assessment for the purposes of paragraph 1242(5)(a) of Schedule 1 or paragraph 494.224(2)(a) or subparagraph (4)(a)(iii) of Schedule 2 to the Regulations was made before, on or after that day.

Previous assessing authorities also specified for visa applications made on or after commencement if application for assessment is made before commencement

 (2) For the purposes of subsection 494.224(6) of Schedule 2 to the Regulations, a person or body listed in column 2 of an item of the following table is also specified as the assessing authority for the occupation listed in column 1 of the item in relation to an application for a Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa if:

 (a) the application for the visa is made on or after the day the amending instrument commences; and

 (b) the application for the skills assessment for the purposes of paragraph 1242(5)(a) of Schedule 1 or paragraph 494.224(2)(a) or subparagraph (4)(a)(iii) of Schedule 2 to the Regulations was made before the day the amending instrument commences.
