This instrument is the Defence (Individual Benefits) Determination 2022
(No. 7).

2  Commencement

1. Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Purpose

The purpose of this Determination is to provide a member commencing a long-term posting overseas a travel benefit for a close relative to accompany the member to the overseas posting location and provide care arrangements for the member’s dependants and to assist with the member’s return to Australia at the end of their posting.

5  Definition

In this Determination, the following apply.

Baggage benefits means benefits provided under Chapter 14 Part 4 Division 2 of the Defence Determination that the member’s close relative would be eligible for if they were a dependant of the member.

Close relative means a sister of the member to whom this Determination applies.

  Decision maker means a person working in the Pay and Administration Centre – Victoria who is an Overseas Administration Team Leader.

Defence Determination means Defence Determination 2016/19, Conditions of service, as in force from time to time.

Dependant has the same meaning given by section 12.3.5 of the Defence Determination.

Health care means benefits provided under Chapter 15 Part 5 Division 2 of the Defence Determination that the member’s close relative would have been eligible for if they were a dependant of the member.

Travel costs means benefits under section 14.4.6 of the Defence Determination that the member’s close relative would be eligible for if they were a dependant of the member.

6  Application

This Determination applies to the member holding the employee identification number 8108911.

7  Period of eligibility

Benefits under this Determination apply between the following dates.

  1. For travel at the start of the member’s posting — between the following dates.
    1. Starting on a date set by the decision maker that aligns with the member’s departure from Australia to the overseas posting location.
    2. Ending on the date that is 3 months after the close relative arrives in the member’s posting location.
  2. For travel at the end of the member’s posting — between the following dates.
    1. Starting on a date set by the decision maker that aligns with the member’s return to Australia in connection with the end of their posting to the overseas posting location.
    2. Ending on the date that is 3 months after the close relative arrives in the member’s posting location.

8  Flights

The member is eligible for the following.

  1. For travel at the start of the member’s posting — Return business class flights for their close relative to travel from Australia to the member’s next posting location.
  2. For travel at the end of the member’s posting — Return business class flights for their close relative to travel from Australia to the member’s posting location.

9  Travel costs, baggage and health care benefits

The member is eligible for all of the following for their close relative.

  1. Travel costs.
  2. Baggage benefits.
  3. Health care.

10  Other travel-related costs

The member is eligible for reimbursement of any of the following travel-related costs which are incurred by their close relative for the purpose of travel under this Determination.

  1. The cost of a passport.
  2. The cost of a visa.

11  Effect of cancellation of posting

If the member’s long-term posting overseas is cancelled on request of the member before the posting commences, the member must repay the cost of benefit received under this Determination that cannot be refunded.
