Schedule 1—Closure areas
This instrument is the Fisheries Management (Bass Strait Central Zone Scallop Fishery) (Closures) Direction 2023.
This instrument commences on 8 July 2023.
This instrument ceases on 1 January 2024.
This instrument is made under subsection 41A(2) of the Act.
(1) In this instrument:
Act means the Fisheries Management Act 1991.
Management Plan means Bass Strait Central Zone Scallop Fishery Management Plan 2002.
Apollo Bay The Hill North area means the part of the fishery described in clause 1 of Schedule 1.
Flinders Island North of Babel area means the part of the fishery described in clause 2 of Schedule 1.
Flinders Island 1 area means the part of the fishery described in clause 3 of Schedule 1.
King Island Three Hummocks Deep area means the part of the fishery described in clause 4 of Schedule 1.
World Geodetic System 1984 (WGS84) means the World Geodetic System 1984 datum that is used for cartography, geodesy, and satellite navigation purposes and is defined and maintained by the United States National Geospatial-Intelligence Agency.
(2) Terms used in this Direction that are defined for the purpose of the Bass Strait Central Zone Scallop Fishery Management Plan 2002 (Management Plan) have the same meanings in this instrument as they have in the Management Plan.
Note: Terms defined in the Fisheries Management Act 1991 have the same meaning in this instrument (see paragraph 13(1)(b) of the Legislation Act 2003).
6 Direction not to engage in fishing
(1) A holder, or a person acting on the holder’s behalf, is directed not to engage in fishing during the 2023 fishing season in parts of the fishery that are:
(a) the Apollo Bay The Hill North area; and
(b) the Flinders Island North of Babel area; and
(c) the Flinders Island 1 area; and
(d) the King Island Three Hummocks Deep area.
(2) This Direction applies for the period from the commencement of this instrument until 31 December 2023.
Note: All geographic coordinates contained within the schedules attached to this document are in terms of the World Geodetic System 1984 (WGS84).
1 Apollo Bay The Hill North area
The area of the fishery that is the Apollo Bay the Hill North area is part of the fishery bounded by the line starting at the point described in item 1 of the following table and running sequentially as described in the table.
