1  Name

  This instrument is the Health Insurance (Section 3C General Medical Services – Other Medical Practitioner) Amendment (No. 2) Determination 2023.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

Immediately after the commencement of Schedule 5 of the Health Insurance Legislation Amendment (2023 Measures No. 3) Regulations 2023.

 

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under subsection 3C(1) of the Health Insurance Act 1973.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Health Insurance (Section 3C General Medical Services – Other Medical Practitioner) Determination 2018

1  Subsection 4(1)

Repeal the following definitions:

(a)           definition of 2016 estimated resident population;

(b)           definition of affected by bushfire;

(c)           definition of ASGS;

(d)           definition of COVID-19 Determination;

(e)           definition of eating disorder treatment and management plan;

(f)            definition of eligible area;

2  Subsection 4(1) (definition of medical practitioner)

Repeal the definition, substitute:

prescribed medical practitioner means a medical practitioner who is not a general practitioner, specialist or consultant physician, and who:

(a)    is registered under section 3GA of the Act, to the extent that the person is practicing during the period in respect of which, and in the location in respect of which, he or she is registered, and insofar as the circumstances specified for paragraph 19AA(3)(b) of the Act apply; or

(b)    is covered by an exemption under subsection 19AB(3) of the Act; or

(c)    first became a medical practitioner before 1 November 1996.

3. Subsection 4(1)

Repeal the following definitions:

(a)           definition of Modified Monash 1 area;

(b)           definition of Modified Monash 2 area;

(c)           definition of Modified Monash 3 area;

(d)           definition of Modified Monash 4 area;

(e)           definition of Modified Monash 5 area;

(f)            definition of Modified Monash 6 area;

(g)           definition of Modified Monash 7 area;

(h)           definition of telehealth area.

4  Section 6

Repeal the section, substitute:

6. Application of general provisions of the general medical services table

(1)           Clause 1.2.1 of the general medical services table shall have effect as if an item in Schedule 1 of this Determination were specified in Schedule 1 of the general medical services table.

(2)           Clause 1.2.5 of the general medical services table shall have effect as if:

(a)    an item in Schedule 1 of this Determination were specified in subclause 1.2.5(1) of the general medical services table; and

(b)    an item in Schedule 1 of this Determination were specified in subclause 1.2.5(3) of the general medical services table.

(3)           Clause 1.2.7 of the general medical services table shall have effect as if an item in Schedule 1 of this Determination were also specified in subclause 1.2.7(1).

(4)           Clause 1.2.8 of the general medical services table shall have effect as if an item in Schedule 1 of this Determination were also specified in clause 1.2.8.

(5)           Clause 1.2.9 of the general medical services table shall have effect as if an item in Schedule 1 of this Determination were also specified in clause 1.2.9.

(6)           Clause 1.2.10 of the general medical services table shall have effect as if an item in Schedule 1 of this Determination were also specified in clause 1.2.10.
