Road Vehicle Standards (Classes of Vehicles that are Road Vehicles) Determination 2021

 

1  Name

  This instrument is the Road Vehicle Standards (Classes of Vehicles that are Road Vehicles) Amendment Determination 2023.

2  Commencement

  This instrument commences on the day after it is registered.

3  Authority

  This instrument is made under paragraph 6(5)(a) of the Road Vehicle Standards Act 2018.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Road Vehicle Standards (Classes of Vehicles that are Road Vehicles) Determination 2021

1  Subsection 5(1) (paragraph (b) of the definition of concrete pumper)

Omit ‘is mounted on a rubber-tyred motor vehicle’, substitute ‘is designed to travel on rubber tyres’.

2  Subsection 5(1) (definition of mobile crane)

Repeal the definition, substitute:

mobile crane means a motor vehicle, other than a forklift or rough terrain crane, that:

 (a) is designed to lift a load; and

 (b) is designed to travel on rubber tyres; and

 (c) is capable of travelling at a reasonable speed by road without obstructing the flow of traffic; and

 (d) has a cabin that allows the operator to drive the vehicle between sites; and

 (e) has one or more road-going features.

3  Subsection 5(1)

Insert:

rough terrain crane means a motor vehicle that:

 (a) is designed to lift a load; and

 (b) is designed for off-road use; and

 (c) is designed to travel on rubber tyres; and

 (d) has a cabin that allows the operator to drive the vehicle on site; and

 (e) has a boom projecting more than 5.5 metres in front of a transverse vertical plane through the centre of the steering wheel.
