The Australian Communications and Media Authority makes this instrument under subsection 110A(2) and section 119 of the Radiocommunications Act 1992.

1  Name

This is the Radiocommunications (Amateur Licences) Amendment Instrument 2023 (No. 1).

2  Commencement

  This instrument commences on the later of:

 (a) the start of the day after the day the instrument is registered; and

 (b) immediately after the commencement of the Radiocommunications (Amateur Stations) Class Licence 2023.

Note 1: The instrument and the Radiocommunications (Amateur Stations) Class Licence 2023 will be registered on the Federal Register of Legislation, which is available, free of charge, at www.legislation.gov.au.

Note 2: Both of these events must occur before this instrument commences.

3  Authority

  This instrument is made under subsection 110A(2) and section 119 of the Radiocommunications Act 1992.

4  Amendments – Radiocommunications Licence Conditions (Amateur Licence) Determination 2015

  The instrument that is specified in Schedule 1 to this instrument is amended as set out in the items in that Schedule.

5  Amendments – Radiocommunications (Qualified Operators) Determination 2016

  The instrument that is specified in Schedule 2 to this instrument is amended as set out in the items in that Schedule.

Radiocommunications Licence Conditions (Amateur Licence) Determination 2015 (F2015L01113)

1  Subsection 3(1)

Insert:

ACMA recognition certificate has the same meaning as in the Radiocommunications (Amateur Stations) Class Licence 2023.

Note The Radiocommunications (Amateur Stations) Class Licence 2023 is available, free of charge, on the Federal Register of Legislation at: www.legislation.gov.au.

qualified operator means a person who holds:

 (a) a certificate of proficiency; or

 (b) an ACMA recognition certificate.

2  Subsection 3(1) (Note 1)

Omit:

3  Subsection 3(1) (after Note 2)

Insert:

Note 3 The definition of qualified operator in this Determination is different to the definition in section 5 of the Act.

4  After section 4

Insert:

4A Qualifications

  The licensee must be a qualified operator.

5  Subsection 9(2) (Note)

Omit the note.
