The Australian Communications and Media Authority makes the following instrument under subsection 132(1) of the Radiocommunications Act 1992.

1  Name

  This is the Radiocommunications (Communication with Space Object) Class Licence Variation 2023 (No. 1).

2  Commencement

  This instrument commences on the day after the day it is registered on the Federal Register of Legislation.

3  Authority

  This instrument is made under subsection 132(1) of the Radiocommunications Act 1992.

4  Variations

  The instrument that is specified in Schedule 1 is varied as set out in the applicable items in that Schedule.

 

Schedule 1—Variations

Radiocommunications (Communication with Space Object) Class Licence 2015 (F2015L01486)

1  Subsection 4(1) (note 2)

After “ area-wide receive station”, insert “ earth receive licence”.

2  Subparagraph 6(a)(iia)

Repeal the subparagraph, substitute:

(iia) 1668 to 1675 MHz; or

(iib) 2005 to 2010 MHz; or

3  Subparagraph 6(b)(iv)

Omit “1525”, substitute “1518”.

4  Subsection 8(2)

Omit “frequency range of 1610 to 1626.5 MHz”, substitute “frequency ranges of 1610 to 1626.5 MHz and 1670 to 1675 MHz”.

5  Subsection 8(3)

Omit “frequency range of 1660 to 1660.5 MHz”, substitute “frequency ranges of 1660 to 1660.5 MHz and 1668 to 1670 MHz”.

6  After paragraph 8(3)

Insert:

(3A) This class licence does not authorise the operation of a station in the frequency range of 1673.38 to 1675 MHz if the emissions of the radiocommunications transmitter of the station exceed a level of -128.1 dBm/4MHz for more than 20% of the time at the output of the antenna of any radiocommunications receiver authorised to operate in all or part of that frequency range under an earth receive licence.

7  Section 8 (note 2)

Omit “Radiocommunications (Mid-West Radio Quiet Zone) Frequency Band Plan 2011”, substitute “Radiocommunications (Australian Radio Quiet Zone Western Australia) Frequency Band Plan 2023”.

8  Section 8 (note 3)

Omit “item 1 of the Schedule to the Radiocommunications (Mid-West Radio Quiet Zone) Frequency Band Plan 2011”, substitute “item 1 of Schedule 1 to the Radiocommunications (Australian Radio Quiet Zone Western Australia) Frequency Band Plan 2023”.
