Biosecurity Regulation 2016

1  Name

  This instrument is the Biosecurity Amendment (Extending Cost Recovery to Low Value Goods) Regulations 2024.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under the Biosecurity Act 2015.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

 

Biosecurity Regulation 2016

1  After subsection 108(4A)

Insert:

 (4B) A charge in relation to a biosecurity matter prescribed by item 2A of the table in subsection 9(1) of the Biosecurity Charges Imposition (Customs) Regulation 2016 or item 2A of the table in subsection 9(1) of the Biosecurity Charges Imposition (General) Regulation 2016 is due and payable on or before:

 (a) if the selfassessed clearance declaration was given during the period of 3 months beginning on 1 January in a year—the 30th day after the end of that period; or

 (b) if the selfassessed clearance declaration was given during the period of 3 months beginning on 1 April in a year—the 30th day after the end of that period; or

 (c) if the selfassessed clearance declaration was given during the period of 3 months beginning on 1 July in a year—the 30th day after the end of that period; or

 (d) if the selfassessed clearance declaration was given during the period of 3 months beginning on 1 October in a year—the 30th day after the end of that period.

2  Subsection 108(5)

After “subsection (4A)”, insert “or (4B)”.

3  After paragraph 109(4)(a)

Insert:

 (aa) in relation to the biosecurity matter prescribed by item 2A in the table—the person who gave the selfassessed clearance declaration;
