1  Name

This instrument is the Defence (Individual benefits) Determination 2024 (No. 4).

2  Commencement

1. Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

 Note: this table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

2. Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Purpose

 The purpose of this Determination is to provide a removal and associated travel costs to the family of a former member in exceptional circumstances.

5  Application

This Determination applies to the family of the former member who held employee identification number 8143802.

6  Definitions

Defence Determination means Defence Determination 2016/19, Conditions of service, as in force from time to time.

Family means a member of the family of the former member who was resident family of the former member immediately before the former member ceased continuous full-time service.

Former member means the former member who held employee identification number 8143802.

Housing benefit location has the same meaning as section 1.3.10 of the Defence Determination.

Removal means a removal under Chapter 6 Part 5 Division 6 of the Defence Determination.

Resident Family has the same meaning given by Section 1.3.1 of the Defence Determination.

7  Removal benefit

1.          The family are eligible for a removal if the former member ceases to be eligible for a removal on ceasing continuous full-time service under the Defence Determination.
2.          The removal is between the following locations.
   1.                    The last housing benefit location of the former member before they ceased continuous full-time service.
   2.                    A location in Australia chosen by the family.
3.          The family are not eligible for a removal the former member has already received as a consequence of ceasing continuous full-time service.  
4.          The removal must be taken no later than 13 October 2026.

8  Associated benefits

1.          The family is eligible for the benefits under the Defence Determination that the former member would have received as a consequence of the removal had the removal been taken by the former member.
2.          The family are not eligible for any of the associated benefits the former member has already received as a consequence of being eligible for the removal.
3.          Associated benefits are payable to the family at the rate that applies under the Defence Determination at the time the benefit is provided.

9  Contribution

1.          Any contribution the former member would have been required to make in connection with the removal or the consequential benefits associated with the removal must be paid by the family. 
2.          Contributions are payable at the rate that applies under the Defence Determination at the time the benefit is provided.

10  Revocation

This Determination is revoked on 14 October 2026.
