This instrument is the Special Broadcasting Service Corporation (Non-executive Director—Selection Criteria) Determination 2024.

This instrument commences on the day after the instrument is registered.

3 Authority

This instrument is made under subsection 43A(1) of the Special Broadcasting Service Act 1991.

4 Definitions

Note: A number of expressions used in this instrument are defined in section 3 of the Act, including the following:

non-executive Director.

In this instrument:

Act means the Special Broadcasting Service Act 1991.

Charter means the Charter of the SBS described in subsection 6(3) of the Act.

SBS means the Special Broadcasting Service Corporation.

5 Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

6 Selection criteria for the Chairperson and non-executive Directors

Note: The position referred to in paragraph 8(aa) of the Act is the position of the Chairperson. The position referred to in paragraph 8(b) of Act is the position of other non-executive Director (and does not include the Managing Director).

For subsection 43A(1), the following selection criteria is determined for the appointment of a non-executive Director referred to in paragraph 8(aa) or (b) of the Act:
1. the person must demonstrate substantial experience or knowledge in at least one of the following fields:
  1. the media industry;
  2. broadcasting and digital media;
  3. digital technologies in any sector other than the media sector;
  4. business or financial management;
  5. creative arts;
  6. educational content creation;
  7. corporate governance, including managing large and/or complex operations in the private, public or not-for-profit sectors;
  8. cultural industry and/or cultural policy, including its administration;
  9. industrial relations, including an understanding of interests of employees; and
2. the person must possess:
  1. demonstrated high-level leadership and vision, and the ability to articulate a clear direction for an organisation;
  2. financial literacy;
  3. high-level judgement;
  4. the highest standards of professional and personal integrity;
  5. an understanding of, or the ability to credibly represent, the communication needs of Australia’s multicultural society, including ethnic and Aboriginal and Torres Strait Islander communities; and
  6. an understanding of the media environment, in particular the role of the SBS as a multilingual and multicultural and Aboriginal and Torres Strait Islander broadcaster, its Charter and its place within the Australian community; and
3. the person demonstrates a commitment to high standards of governance.
