1  Name

  This instrument is the Health Insurance (Section 3C Midwife and Nurse Practitioner Services) Amendment (No. 1) Determination 2024

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under subsection 3C(1) of the Health Insurance Act 1973.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Health Insurance (Section 3C Midwife and Nurse Practitioner Services) Determination 2020

1  Subsection 7(1) (definition of collaborative arrangement)

Repeal the definition.

2  Section 9

Repeal the section.

3  Section 15 (heading)

Repeal the heading, substitute:

15. Scope of practice

4  Subsection 15(1)

Repeal the subsection, substitute:

(1) For a patient, an item in Schedule 2 applies only if the service mentioned in that item is within the scope of practice of the participating nurse practitioner who provides the service.

5  Subsection 15(2)

Repeal the subsection.

6   After section 20  

Insert:

20A. Requirements for item 73825

(1) Item 73825 applies to a service only if:

  1.     the service is rendered at, or from, a practice location in:
  1.             a Modified Monash 6 area; or
  2.             a Modified Monash 7 area;
  1.     the nurse practitioner providing the service:
  1.             is employed by an organisation that:

(A) delivers health services; and

 (B) is participating in the First Nations Molecular Point-of-Care (PoC) Testing Program;

  1.     the service is provided in accordance with the Program referred to in subparagraph (b)(i)(B);
  2.     the service is conducted by a nurse practitioner who has achieved copentency as a PoC operator by the First Nations Molecular PoC Testing Program for the test(s) performed; and
  3.     the PoC test(s) gives valid patient result(s).

7  Schedule 1 (item 82100, column 2, paragraphs (e) and (f))

Repeal the paragraphs, substitute:

 (e)  requesting pathology and diagnostic imaging services, when necessary

8  Schedule 1 (item 82115, column 2, subparagraphs (c)(iv), (v) and (vi))

Repeal the subparagraphs, substitute:

(iv)  details of any medication taken by the patient during the pregnancy, and any additional medication that may be required by the patient; and

(v)   details of any referrals or requests for pathology services or diagnostic imaging services for the patient during the pregnancy, and any additional referrals or requests that may be required for the patient; and

9   Schedule 2 (before item 73826)

 Insert:

73825

Detection performed by a participating nurse practitioner of:

  1.     chlamydia trachomatis (CT) and neisseria gonorrhoeae (NG) via molecular point-of-care testing for the diagnosis of CT or NG infection; and
  2.     trichomonas vaginalis (TV) via molecular point-of-care testing for the diagnosis of TV infection
