1  Name

  This instrument is the Primary Industries Legislation (Repeals and Consequential Amendments) Regulations 2024.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under the following:

 (a) the Australian Meat and Livestock Industry Act 1997;

 (b) the Australian Meat and Livestock Industry (Repeals and Consequential Provisions) Act 1997;

 (c) the Competition and Consumer Act 2010;

 (d) the Customs Act 1901;

 (e) the Primary Industries Research and Development Act 1989;

 (f) the Wine Australia Act 2013;

 (g) the Wool Services Privatisation Act 2000.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Australian Meat and Livestock Industry Regulations 2023

1  Section 1

Omit “Australian Meat and Livestock Industry Regulations 2023”, substitute “Australian Meat and Livestock Industry (Repeals and Consequential Provisions) Regulations 2024”.

2  Sections 3 and 4

Repeal the sections, substitute:

  This instrument is made under the Australian Meat and Livestock Industry (Repeals and Consequential Provisions) Act 1997.

3  Parts 2 and 3

Repeal the Parts.

Competition and Consumer (Industry Codes—Dairy) Regulations 2019

4  Section 5 (definition of Agriculture Minister)

Omit “Dairy Produce Act 1986”, substitute “Primary Industries Levies and Charges Collection Act 2024”.

5  Section 5 (definition of milk)

Repeal the definition, substitute:

milk means the lacteal fluid product:

 (a) of the dairy cow; and

 (b) that is unprocessed.

Competition and Consumer (Industry Codes—Horticulture) Regulations 2017

6  Subclause 39(1) of Schedule 1

Omit “Horticulture Marketing and Research and Development Services Act 2000”, substitute “Primary Industries Levies and Charges Collection Act 2024”.

Customs (Prohibited Imports) Regulations 1956

7  Subregulation 4K(8) (definition of responsible Minister)

Omit “Primary Industries Levies and Charges Collection Act 1991”, substitute “Primary Industries Levies and Charges Collection Act 2024”.

Wine Australia Regulations 2018

8  At the end of Part 2

Add:

6B  Grapes research levy, wine export charge and wine grapes levy

 (1) For the purposes of the definition of grapes research levy in subsection 4(1) of the Act, a prescribed provision is Division 68 of Part 24 of Schedule 2 to the Primary Industries (Excise) Levies Regulations 2024.

 (2) For the purposes of the definition of wine export charge in subsection 4(1) of the Act, a prescribed provision is Division 70 of Part 24 of Schedule 2 to the Primary Industries (Customs) Charges Regulations 2024.

 (3) For the purposes of the definition of wine grapes levy in subsection 4(1) of the Act, a prescribed provision is Division 69 of Part 24 of Schedule 2 to the Primary Industries (Excise) Levies Regulations 2024.

9  In the appropriate position in Part 10

Insert:

Division 3Transitional provisions relating to the Primary Industries Legislation (Repeals and Consequential Amendments) Regulations 2024

120  Transitional provisions

  Division 2 of Part 3 applies on and after the commencement of this section as if a reference to wine export charge included a reference to charge imposed by Schedule 13 to the former Primary Industries (Customs) Charges Act 1999.
