This instrument is the Migration (Australia Travel Declaration—Passenger Card May Be Required) Instrument (LIN 24/075) 2024.
This instrument commences on the day after it is registered.
This instrument is made under subregulation 3.03AB(3) of the Migration Regulations 1994 (the Regulations).
Note: A number of expressions used in this instrument are defined in the Migration Act 1958 and the Regulations, including the following:
(a) Australia Travel Declaration;
(b) clearance authority;
(c) clearance officer;
(d) passenger card.
In this instrument:
Regulations means the Migration Regulations 1994.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
6 When a passenger card may be required
For subregulation 3.03AB(2) of the Regulations, each of the following matters is specified:
(a) the person’s Australia Travel Declaration cannot be accessed by a clearance authority;
(b) a clearance officer reasonably suspects that the information in the person’s Australia Travel Declaration is not accurate or complete.
