This instrument is made under section 33 of the Industry Research and Development Act 1986.
In this instrument:
Act means the Industry Research and Development Act 1986.
Dealership means a licenced motor dealer/trader. This also includes service centres associated with a licenced motor dealer/trader.
Electric vehicle (EV) repairer means an automotive repair business that can demonstrate that they have at least one member of staff suitably qualified to undertake work on EVs and comply with Australian Standard 5732:2022 (EV operations – Maintenance & repair).
Kyoto Protocol means the Kyoto Protocol to the United Nations Framework Convention on Climate Change, done at Kyoto on 11 December 1997, as in force for Australia from time to time.

Paris Agreement means the Paris Agreement, done at Paris on 12 December 2015, as in force for Australia from time to time.

United Nations Framework Convention on Climate Change means the United Nations Framework Convention on Climate Change, done at New York on 9 May 1992, as in force for Australia from time to time.

5 Prescribed program
(1) For the purposes of subsection 33(1) of the Act, the Dealership and Repairer Initiative for Vehicle Electrification Nationally (DRIVEN) Program (the program) is prescribed.
(2) The program provides funding to support the purchase and installation of electric vehicle charging infrastructure at automotive dealerships (including associated servicing centres) and electric vehicle (EV) repairers in Australia.
(3) The purposes of the program are to:
(a) assist businesses to meet the upfront capital costs associated with purchasing and installing electric vehicle charging infrastructure; and
(b) position the Australian automotive industry to support increasing electric vehicle uptake.
For the purposes of subsection 33(3) of the Act, the power of the Parliament to make laws with respect to external affairs (within the meaning of paragraph 51(xxix) of the Constitution) is specified, as it relates to measures to give effect to Australia’s obligations under one or more of the following:
