This instrument is made under the following:
(a) sections 5, 6 and 6A of the Ministers of State Act 1952;
(b) section 5 of the Ministers of State Regulations 2024.
The Ministers of State (Notification of Appointment and Direction) Instrument 2024 is repealed.
The purpose of this instrument is to improve transparency and accountability in relation to the appointment of Ministers of State and the Departments that they administer. It also implements some of the recommendations made in the Report of the Inquiry into the Appointment of the Former Prime Minister to Administer Multiple Departments dated 25 November 2022.
The current Ministers, and the Departments they administer, are set out in Division 2 of Part 2 of this instrument. The Ministers are listed in the order in which the Governor‑General executed the instruments under sections 64 and 65 of the Constitution. Previous Ministers, and the Departments that they administered, for a particular specified period are set out in Division 1 of that Part.
The Official‑Secretary to the Governor‑General is required to notify when the Governor‑General has taken action under sections 62, 64 and 65 of the Constitution relating to Executive Councillors, the administration of Departments or the holding of offices by Ministers. The action may include revocation action.
The notification of those actions is set out in Part 3 of this instrument while copies of the relevant instruments made by the Governor‑General are set out in Part 4 of this instrument. The original instruments made by the Governor‑General can be viewed on the website of the Department of the Prime Minister and Cabinet (https://www.pmc.gov.au/).
In this instrument:
Department means a department of State of the Commonwealth.
