Australian Capital Territory National Land (Road Transport) (Parking Fees) Determination 2025

  This instrument is the Australian Capital Territory National Land (Road Transport) (Parking Fees) Determination 2025.

  This instrument commences immediately after the commencement of the Australian Capital Territory National Land (Road Transport) Rules 2025.

Note: The Rules commenced immediately after the Ordinance, which commenced on 1 April 2025.

  This instrument is made under subsection 96(1) of the Road Transport (General) Act 1999 (ACT)(Cth), as applied by the Australian Capital Territory National Land (Road Transport) Ordinance 2025 and the Australian Capital Territory National Land (Road Transport) Rules 2025.

Note: A number of expressions used in this instrument are defined in the Ordinance or the Rules, including the following:

(a) NCA;

(b) Ordinance.

  In this instrument:

multistay parking area means a ticket parking area where allday parking is permitted by the signs applying to the area.

Rules means the Australian Capital Territory National Land (Road Transport) Rules 2025.

shortstay parking area means any ticket parking area other than a multistay parking area.

third-party parking service provider means a person with whom the Minister (or their delegate) has entered into an arrangement under section 12 of the Ordinance.

 (1) For the purposes of subsection 96(1) of the Road Transport (General) Act 1999 (ACT)(Cth), this section determines the fee payable for the use of a ticket parking space in a ticket parking area that forms part of a ticket parking scheme established by the Minister (or their delegate) under section 35 of the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT)(Cth).

 (2) The amount set out in column 2 of an item in the following table is the fee payable in relation to a ticket parking space in the ticket parking area mentioned in column 1 of that item.

(a) for up to and including 4 hours:

(i) for the first hour—$4.00; and

(ii) for the second hour—$4.00; and

(iii) for the third hour—$4.00; and

(iv) for the fourth hour—$4.00; or

(b) for 1 business day—$17.00; or

(c) for 5 consecutive business days—$82.50.

 

 (3) The fee payable for the use of a ticket parking space in a ticket parking area for part of an hour is the amount set out in table item 1, column 2, paragraphs (a) to (d) or table item 2, column 2, paragraph (a) of the table in subsection (2) that is the pro rata equivalent to the part of the hour.

 (4) The fee is payable to the Commonwealth by the person using the ticket parking space.

 (5) The fee may be collected by a third-party parking service provider on behalf of the Commonwealth.

 (1) For the purposes of subsection 96(1) of the Road Transport (General) Act 1999 (ACT)(Cth), this section determines the fee payable for a parking permit issued by the Minister (or their delegate) under paragraph 64(1)(b) of the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT)(Cth).

 (2) The amount set out in column 2 of an item in the following table is the fee payable in relation to a parking permit mentioned in column 1 of that item.

 (3) The fee is payable to the Commonwealth by the applicant for the parking permit.

 (1) For the purposes of subsection 96(1) of the Road Transport (General) Act 1999 (ACT)(Cth), this section determines the fee payable for a parking permit issued by the Minister (or their delegate) under paragraph 64(1)(c) of the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT)(Cth).

 (2) The amount set out in column 2 of an item in the following table is the fee payable in relation to a parking permit mentioned in column 1 of that item.
