  Reason: The replacement Explanatory Statement explains that the requirements under sections 33, 39 and 39A of the Australian Education Regulations 2023 (‘the Regulations’) are essential to the ongoing monitoring of approved bodies’ compliance with the Australian Education Act 2013 (‘the Act’) and the Regulations; that the collection of information under sections 39 and 39A is limited to information and records that relate to compliance with the Act and Regulations and associated financial administration; and that certain decisions under the Regulations are considered not suitable for merits review. The replacement Explanatory Statement also includes changes to the consultation section.
